The judgment dismisses the appeals filed by various parties—including the Juaneda clinic itself and Grendon Investments—and ratifies the previous decision of the Commercial Court No. 2 of Palma, albeit with different legal reasoning. Specifically, the court recognizes that Vithas correctly exercised its preferential acquisition right over a total of 256,497 shares that had been acquired by Grendon Investments following a capital increase approved in 2022. Consequently, the ruling obliges Grendon to transfer these shares. It must also transfer any other shares it may obtain in future capital increases under the same conditions.

The victim recounted her story in court at the Balearic Islands Provincial Court. The prosecution is seeking a 20-year prison sentence and €40,000 in compensation for the man, who is accused of three counts of domestic abuse and one count of continuous sexual assault. During her testimony, the victim stated that "since she was old enough to understand," her father behaved aggressively toward her and her siblings. "He would hit us at the slightest provocation. I had makeup exams and didn't want to study. He made me kneel and hit me on the legs with a bamboo cane," she recalled, referring to one of the many episodes of abuse that allegedly occurred between 2014 and 2022. Over the years, the abuse escalated into frequent sexual assaults between 2016 and 2022, when she was between 10 and 16 years old. "He would tell me to get over there, spread my legs, and penetrate me," she stated. The young woman, now 22, said she cannot remember the exact number of times her father raped her. She indicated that she didn't tell anyone what happened until later because she was afraid of him. "I was afraid he would hit me," she said.

The legal proceedings, known as the Barraquer case, were resolved with a plea agreement that avoided a trial. The charge was resisting authority. The demonstration was organized by the Palma Housing Union (SHP), whose members displayed a banner with the slogan "Repression will only make us stronger" and chanted slogans such as "No people without homes, no homes without people."

During Wednesday's jury trial at the Provincial Court, several phone calls intercepted from the mother days after she gave birth to the 26-week-old baby were played. "I should have had her here and thrown her in the countryside," she tells the other person, who insists that she not go to the police station until the baby's autopsy is performed. "We did it wrong," the defendant insists to the other person, who tells her that the baby had no chance of surviving and refers to a neighbor's call to 112 (the Spanish emergency number) who became suspicious of the baby's uncle after seeing him loitering around the dumpsters. The mother recounts how the fetus "came out whole" in the car.

In Tuesday's session of the jury trial at the Provincial Court against the child's mother, her brother-in-law, and her sister, a nurse who attended to the newborn at the hospital recalled that the baby's heart was beating, although he insisted that this could have been due to the resuscitation efforts undertaken by all those involved upon confirming the newborn's non-viability. The first to testify was a doctor who, in similar terms, indicated that the baby had oxygen in its blood, although it was already separated from the placenta, which can be considered a sign of vitality. "It's possible that it was alive, but whether it was viable is another matter, especially with the resources available at Levante Hospital," she noted. At the start of the hearing, the presiding judge informed the jury that the baby's mother was hospitalized and had expressed her desire to waive her right to be present at the trial. The mother and the baby's uncle were again in the dock, with the prosecution requesting life imprisonment with the possibility of parole for the latter as alleged perpetrators of murder. The mother's sister-in-law is also accused and faces a fine of €5,400 for allegedly failing to render aid. According to the prosecutor's indictment, the events occurred on November 3, 2023, when the woman, 26 or 27 weeks pregnant, became involved in a car accident in which she was traveling with the other two defendants. After giving birth, and despite being in the vicinity of a hospital, the baby's mother handed the newborn's body over to the man because he threw it into a nearby dumpster and they fled the scene.

He claimed he was in a romantic relationship with the 13-year-old at the time of the alleged incident, and that their sexual relations were always consensual. He appeared at the trial held Thursday in the Second Section of the Provincial Court of the Balearic Islands, where he attributed the accusation to the influence of the girl's mother, who was unaware of the relationship. "There was not a single time I forced her," he asserted. The victim, for her part, denied having a romantic relationship with the alleged perpetrator, stating that it was only a friendship. The young woman, who recently turned 18, explained that on the day of the incident, she went to the man's home for help with her homework and that the sexual assault occurred shortly afterward. "We were on the sofa and he jumped on top of me. I froze," she said. The prosecution is requesting a seven-year prison sentence and €4,000 in compensation as the alleged perpetrator of a sexual abuse crime. According to the prosecutor's indictment, the events date back to August 2021, when the accused contacted the victim, who was 13 years old at the time, through a well-known social network. Despite knowing her age, the man maintained contact with her. In May 2022, he offered to help her with her English homework and invited her to his home in Palma. There, after they finished their schoolwork, he began to subject the minor to inappropriate touching and then raped her. The victim, deeply traumatized, told her mother what had happened a month later, and they reported the incident to the National Police.

The First Section of the Provincial Court is trying both officers and the victim, who is also accused of assaulting the officers during an incident that occurred on April 14, 2021, in Palma. The hearing began with the testimony of the victim's alleged partner, who is also accused of assault and causing damage to the officers. The man admitted that he had an argument with his partner that night, although he denied that she assaulted or threatened him. At that point, they went their separate ways, although she called emergency services (112), which the man learned later. Shortly afterward, he encountered a group of National Police officers. "I thought it was a raid or that they were going to fine me for not wearing a mask, but one of them, very agitated, told me, 'I'll teach you to respect women,' and started hitting me with his baton," he explained. He claimed he could only cover himself to protect himself from the blows. "They wouldn't tell me anything. I told them I'd let them arrest me, but to stop hitting me," he stated. The prosecution is requesting that both officers be sentenced to 11 months in prison for assault and that the third defendant receive a sentence of three years and two months for assault, property damage, and resisting arrest. According to the prosecutor's indictment, the events occurred on the night of March 14, 2021, when several police patrols were dispatched to a street in Palma after receiving a report of a possible case of gender-based violence.

These are the lawyers who guide, assist, advise, and defend those eligible for free legal aid at any time of day, a right reserved for individuals who meet certain income thresholds and belong to vulnerable groups. All of these lawyers combine their duty counsel with private practice. The 87 to 150 euros they receive for a 24-hour shift in jurisdictions such as gender violence or criminal cases do not allow for full-time dedication. "We are driven by a vocation of service to the public, because it is very poorly paid," confirms Carmen López, Vice Dean of the Balearic Islands Bar Association (ICAIB) and head of the duty counsel service. She herself, with 34 years of experience, practices in criminal and juvenile law. "For me, the experience is very enriching; each case is a challenge," she says about the possibility of defending minors, a branch of law almost exclusively handled by public defenders.

The prosecutor asserted in the first session that "there is more than enough evidence for a conviction" and maintained that there is no dispute that the accused caused the victim's death. The hearing began after 1 p.m., following the selection of the jury, which will determine the guilt or innocence of both the homeowner, accused of homicide, and the other three men, charged with attempted robbery. The prosecution is requesting a 15-year prison sentence for the homeowner and 11 months for each of the three assailants. It is also seeking approximately €157,000 in compensation for the victim's family. During the preliminary hearing and the reading of the initial reports, the prosecutor emphasized that "the fact that the accused killed a person is not in dispute" and that the evidence presented supports a conviction. The defense attorneys for the mother, sister, and father of the deceased young man went further, arguing that the events constitute not manslaughter, but murder, based on two aggravating circumstances: surprise and cruelty. They argued that the victim was attacked from behind and received "a large number of stab wounds" until he bled to death. "It wasn't a three-on-one situation, but rather an unarmed person who was surprised and repeatedly stabbed," stated the lawyer for the young man's father.

The First Section of the Provincial Court of Palma will try two men next Thursday accused of sexually assaulting a minor who, at the time, was between 14 and 15 years old and under the guardianship of the Administration in Mallorca. A third defendant in the same case will not be in the dock because he is currently a fugitive. According to the indictment from the Public Prosecutor's Office, the events occurred between the summer of 2019 and February 2020. During this period, the minor was allegedly the victim of at least three sexual assaults: two allegedly committed by one of the defendants and a third attributed to the second defendant. The Prosecutor's Office is requesting a 12-year prison sentence for each of the men as alleged perpetrators of two counts of sexual assault against a minor under 16 years of age. Furthermore, the prosecution is demanding that they jointly compensate the victim with a total of €30,000 and that a restraining order be imposed on them for 12 years with respect to the victim, who is now an adult. The first assault allegedly occurred when the minor stayed overnight for several days at the home of one of the defendants, on an unspecified date. According to the prosecution, one morning, when the young woman woke up, the man was lying next to her and propositioned her for sex. When the minor refused, the accused allegedly touched her inappropriately and attempted to rape her. On a second occasion, with the same man, the victim was in a bar when the accused turned off the establishment's security cameras and forced her into a storage room where he had set up a bed. There, he allegedly attempted to rape her again, but was unsuccessful because another person entered the bar asking for him. The third sexual assault attributed to the second defendant also allegedly began in a bar, where the two met. They later went to the defendant's home, where, according to the prosecutor's account, he forced the minor into one of the bathrooms and raped her. The third defendant, also under investigation for the same events, will not be tried at this hearing as he is currently a fugitive.
