Furthermore, the government is violating the 2022 Law on Island Councils, which stipulates that the Executive Branch must complete the transfer of the functions outlined in the Statute of Autonomy.

The Government has set December 31 as the deadline to find a solution for the General Agrarian Association of Mallorca (AgamaAccording to sources within the Balearic Islands government speaking to ARA Baleares, "This is the deadline; otherwise, we won't have any room to maneuver or reverse the situation." Sources in the primary sector added that Agama will buy milk from one of the three producers who currently supply it until October 31, 2026, but emphasized that, starting March 31, this milk will no longer be processed in Mallorca because Damm's lease agreement with Comercial Bordoy for the facilities will expire. The situation at Agama is causing concern among farmers and agricultural associations. Joan Gaià, coordinator of Unió de Pagesos, warned in the Balearic Parliament that the closure of Agama would be "an attack on the food sovereignty" of the Balearic Islands. He also listed other issues that worry farmers, such as the lack of social consideration and the effects of climate change. "What country in the world can afford to do without the dairy industry? It's very important and continues to be a loss leader in supermarkets, which is what has brought the state and Mallorcan sectors to where they are today," he stressed. Gaià lamented that there hasn't been enough self-criticism and that no one has been "brave enough" to raise their voices against the closure of Agama. "The interests of a business group cannot take precedence over those of a people. Closing Agama is an attack on the food sovereignty of the people of the Balearic Islands," he insisted.

The owners of a dozen rural plots of land on the outskirts of municipalities like Palma and Calvià, as well as in Ibiza, have already begun taking steps to capitalize on the automatic rezoning promoted by the government of Marga Prohens, which could generate capital gains of over 2,000%. The Land Acquisition Law has prompted various owners and developers to sit down and negotiate, attempting to launch projects given this unique opportunity to secure millions in development rights, ostensibly to build new housing. Some of these transactions have already been announced through public tenders. Others are still being discussed behind closed doors. Most of these plots are not new to the real estate market; their current owners have already attempted to rezone their land.

The Union of Farmers of Mallorca, Asaja Baleares, UPA-AIA, and Agri-food Cooperatives maintain that the future Balearic agricultural law will be "a tool of the sector and for the sector" and have criticized other groups for "wanting to dictate" the future of farmers, ranchers, and cooperatives in the Islands. It should be noted that this legislation will allow up to 10 tourist accommodations on each farm.

Mallorca's hoteliers believe it is a mistake to ensure the viability of the agricultural sector by creating more tourist accommodations and have asked the Ministry of Agriculture, in their objections to the agricultural law, not to generate additional lodging capacity. The hoteliers' objections are not limited to criticizing the touristification of the agricultural sector; they also demand that the Government truly prioritize the primary sector and declare it an essential and strategic service, so that more public resources are allocated to it systematically and regularly. The hoteliers propose working with a specific framework for the primary sector that includes official recognition and allows for the financing of productive activities and support due to their strategic importance. "They generate value, food, landscape, and there is a consensus on their importance. But what we absolutely cannot understand is the proposal to make them viable by orienting them towards tourism," lamented Aguiló. In this regard, the hoteliers believe that "all possibilities must be explored, from increasing the ecotax funds for the sector to demanding that, with a formal declaration of the sector as strategic and essential, European and state funds be secured, given their undeniable contribution to the wealth of the Islands," he explained. This refers to the draft agricultural law, whose public consultation has just ended. Another criticism from the hoteliers is that the Ministry of Agriculture can authorize new agricultural estates within rural land without taking into account that the powers in this matter belong exclusively "to the island councils, which are thus being overruled." "The councils are the ones who should decide what can and cannot be done on rural land. Furthermore, promoting new accommodations in the countryside is to distort its character and go against the spirit of the primary sector," Aguiló lamented. Hoteliers believe that if there is a significant debate about overcrowding, it makes no sense to promote it in the countryside with more tourists. "We already know what happened when we put tourists in apartments, and now we want to put them in the countryside?" the vice president asked. The regulation has received a barrage of criticism, especially because it introduces tourist and residential categories into rural areas. Even the Tourism Promotion Association, an organization that rarely comments on draft legislation, has sent a letter to President Marga Prohens warning that its members "are upset and concerned about initiatives such as the proposed agricultural law," because "it introduces aspects that could extend beyond the scope of agricultural activity and distort its nature." This organization also considers it important to limit the products that can be sold directly and the activities that can be carried out in order "not to create unfair competition with agritourism and other legally established sectors."

The Balearic Islands Federation of Business Owners (Afedeco) asserts that the draft agricultural law being promoted by the government could negatively impact the sector, as it opens the door to new commercial establishments under the guise of promoting direct sales. According to Afedeco's president, Joana Manresa, the draft introduces concepts that "may extend beyond the agricultural sphere and directly affect the regulation of retail trade," which could create legal uncertainty and disadvantage legally established businesses. Business owners are asking the Ministry of Agriculture for regulatory "consistency" and, therefore, for respect for current urban planning regulations "to avoid contradictions" and prevent potential situations of unfair competition under the pretext of promoting direct sales. They maintain they are not against farms selling their products, but say the wording of the law goes much further and could harm them with new establishments.

Farmers, professionals, and organizations such as the GOB (National Agricultural Association), Unió de Pagesos (Union of Pagesos), and the organic producers' association Apaema (Apaema) have demanded that the government fundamentally amend the draft agrarian law because it "will disfigure the countryside" and have criticized the current wording as an initiative to promote urban and tourism uses that "will end up converting farms into hotels." They also regret that the law is not being used to "promote true food sovereignty and to seriously help make agricultural activity viable on the islands," according to spokespersons for these associations told ARA Baleares. There are some points of agreement among the organizations and professionals who have presented objections, particularly regarding criticism of the urban, tourist, and speculative orientation of the countryside, which instead focuses on improving food production, which "is the basis of any agricultural regulation." The environmentalists are calling for the government to withdraw the law as drafted.

The environmental group GEN-GOB has sent a letter to the Ministry of Agriculture requesting the withdrawal of the draft agricultural law, which is currently undergoing public consultation. They argue that the Balearic Islands Government "intends to deliver the final blow to the farming community," making it a target for investment funds and tourism companies to incorporate into "the islands' over-developed tourism sector," exacerbating the problem of dependence on tourism and "relegating farming to a marginal activity."

The Minister of Agriculture, Fisheries and the Natural Environment, Joan Simonet, acknowledged this Wednesday that, as the ARA Baleares announced this weekend, with the approval of the new agrarian law Tourist places will be increased from 6 to 10 on farms with preferential or priority status—those professionally engaged in agriculture.

Farms with preferential or priority status—those professionally engaged in agriculture—will be able to request up to 10 tourist beds. This is a "blunder" according to conservation groups and some agricultural organizations, and a "necessity" according to the Executive, which maintains that it is the only way to make viable a sector that has been in decline for years.

The Mallorca Regional Government (GOB) and the Estellencs Landscape Defense Association have filed two complaints with the International Council on Monuments and Sites (ICOMOS), an advisory body to UNESCO, warning that "the Tramuntana mountain range is in a critical state of degradation, aggravated and accelerated by the deregulatory policies of the Catalan government." The organizations warn that, with the regulatory reforms approved in recent months, the government of Marga Prohens "has turned the mountain range into an unprotected territory in the face of speculative and tourist pressure, putting at risk the universal values that justified its recognition as a World Heritage Site in 2011."

Around twenty farmers from different parts of Mallorca have presented objections to the draft agrarian law for the Balearic Islands, which is currently on public display, and are demanding its immediate withdrawal. They believe the text "represents the definitive renunciation of decent and functional agricultural activity" and denounce that, under the guise of a green law, "it opens the door to greater covert urbanization, speculation, and non-agricultural uses of rural land."
