The Palma City Council, ordered to compensate three residents for the noise from concerts at the bullring

The TSJIB recognizes the violation of fundamental rights due to nocturnal disturbances and sets compensation of 9,000 euros

PalmThe Palma City Council will have to compensate three residents of the bullring with 9,000 euros for the disturbances caused by concerts and nighttime shows held at the venue.

The Superior Court of Justice of the Balearic Islands (TSJIB) has partially upheld the appeal filed by those affected and has annulled the previous ruling, which had dismissed their claim. The court concludes that the authorization of these events by the City Council violated the fundamental rights of the residents, specifically the right to privacy and moral integrity.

For this reason, it sets compensation of 3,000 euros for each of the three affected parties.

Noise above the limit

The events date back to July, when residents reported to Cort that concerts at the bullring were generating noise levels exceeding legal limits.

In their statement, they demanded measures to end these disturbances, including the possible relocation of events, and financial compensation for the damages suffered. They also requested an additional compensation of 500 euros for each new event that exceeded the noise limits.

Given the lack of a municipal response, in September they filed an administrative litigation appeal through the protection of fundamental rights.

Change in judicial criteria

In a first ruling, the court dismissed the lawsuit, considering that the City Council had acted correctly, as it had opened eight sanctioning proceedings for noise pollution and had decreed the precautionary closure of the premises.

The neighbors, however, appealed the decision, arguing that these proceedings precisely demonstrated the existence of the disturbances and denouncing errors in the resolution.

Now, the TSJIB supports their claim and considers that there was indeed a violation of fundamental rights.

The ruling is not final and can be appealed before the Supreme Court.
