The Council of Mallorca applauds the Supreme Court's annulment of the state tourist rental registry

The insular institution considers that the state registry has generated "regulatory confusion" and a detriment to the tourism sector, which for months has had to operate in a context of uncertainty

PalmaThe Consell de Mallorca upholds the Supreme Court (TS) ruling that annuls the state's single registry of tourist rentals, considering that the State lacks the competence to impose this regulation against existing autonomous systems.

The Minister of Tourism, Guillem Ginard, has pointed out that the judicial decision confirms the warnings made by the island institution from the outset regarding the lack of legal certainty and territorial consensus in the implementation of this measure. According to the Consell, the state registry has generated "regulatory confusion" and a detriment to the tourism sector, which for months has had to operate in a context of regulatory uncertainty.

Ginard has criticized that the norm was promoted without agreement with the autonomous communities and has defended that the regulation of tourist rentals corresponds to the territories and, in the case of Mallorca, to the Consell itself. The island institution has pointed out that the state registry excluded part of the regulated supply on the island, especially those properties exclusively intended for tourist activity according to autonomous regulations, which exacerbated its impact on the sector.

Likewise, it has warned that the application of this measure entailed an additional administrative burden for the island councils, obliged to process certificates, in addition to generating economic damages for companies and owners. The Consell has urged the central government to take measures against those responsible for the implementation of this regulation, considering that it was done despite the warnings from the institutions and with negative effects for the tourism sector of Mallorca.
