The ‘Maricarmen decree’ has already paralyzed three evictions in Mallorca

Stop Evictions ensures that the courts have taken into account the new regulations, together with other legal arguments, to postpone the proceedings

PalmaThe ‘Maricarmen decree’ has already served as a legal basis to suspend at least three evictions in Mallorca, according to the spokesperson for Stop Desnonaments Mallorca, Joan Segura. These are three procedures that were scheduled for these days in Inca and Palma and which, according to the entity, the courts have postponed after taking into account the new regulations, along with other legal arguments.

The first suspension took place this Wednesday and affects a family from Inca. The procedure was related to the home where they reside, which had been immersed in a litigation with the developers and builders until it finally passed into the hands of Sareb. According to Segura, the entity would not have agreed to negotiate either the purchase or a rental contract with the family.

Those affected have also requested the mediation of the Inca City Council. Specifically, they have asked the mayor, Virgilio Moreno, to intercede with Sareb to try to find a way out of the conflict.

A mother with two children in Son Gotleu

A second eviction that was scheduled for this Friday has also been suspended. In this case, it involves a mother with two children who lives in a rental property in Son Gotleu, in Palma.

According to what Segura explained, the property belongs to a private individual who allegedly bought it from an investment fund that had previously acquired it from a banking entity. The family had allegedly paid seven months of rent before stopping payments when they became aware that an eviction order was pending on the property following a lawsuit from the previous owner.

The spokesperson for Stop Desnonaments considers that the current owner could be considered a large property holder, as they are dedicated to the buying, selling, and renting of real estate. According to Segura, the Balearic Housing Institute (Ibavi) was allegedly unaware of this situation or did not receive this information.

The third case corresponds to a couple with two children, one of whom has a disability, and the eviction has also been suspended in Palma. Activists had already managed to postpone this procedure in July, when they gathered in front of the building.

According to Stop Desnonaments, the property had been owned by a banking entity and subsequently passed through several holders until ending up in the hands of a private individual, who was collecting rent from the family.

More evictions scheduled during October

Despite these three suspensions, the Stop Evictions calendar still includes another eviction scheduled for Tuesday, in addition to other proceedings marked for October 13th, 15th, and 19th.

The organization considers that the new regulation may offer a new way to try to stop these proceedings, but each case will have to be resolved by the corresponding courts.
