They criminally report the company of local police officer Rafael Ramis for the evictions of Joan Miró in Palma

PalmaStop Desnonaments Mallorca has announced that last week it filed a criminal complaint before the Court of First Instance against the company Barama Nesa SL, its sole administrator, Rafael Ramis Sastre, and its legal representatives. The platform considers that in the judicial proceedings related to the dwellings in the basements of Avinguda de Joan Miró, 24B, alleged crimes of procedural fraud, fraud of law, and abuse of right may have occurred.

The entity assures that this action is part of its strategy to defend the families residing in these properties and states that it will continue to combine judicial actions with citizen mobilization.

Three evictions planned

The platform warns that this Thursday, July 23, three evictions are planned. Two affect families living in the basements of Joan Miró, 24B, while the third concerns a family linked to a dwelling managed by the Balearic Institute of Housing (Ibavi).

According to Stop Desnonaments, the criminal complaint has only allowed the provisional suspension of one of the procedures related to Joan Miró to be requested. In the case of the second family, they explain that the court recognized their vulnerable situation, but did not suspend the eviction. The organization plans to file a new judicial brief to also request its suspension.

Regarding the third case, the platform criticizes Ibavi for promoting the eviction of a family that, according to them, had taken care of the contract holder of the dwelling before her death. It also denounces possible procedural irregularities related to the family's legal representation and states that a request for nullity of proceedings has been filed.

All in all, Stop Desnonaments Mallorca calls on citizens to participate in the mobilization called for this Thursday with the aim of preventing the three planned evictions.

The organization recalls that last Monday two evictions were successfully suspended, one of which had been notified with less than two hours' notice, and considers that these precedents show that citizen mobilization can be effective.

In its statement, Stop Desnonaments accuses Barama Nesa SL of having developed a procedural strategy to avoid the application of certain protection measures provided for in housing legislation, which, according to the platform, would prevent the affected families from accessing mediation mechanisms and a residential alternative.

Furthermore, the organization denounces that the families residing in the basements are suffering from cuts to basic water and electricity supplies, which it attributes to the owner company.
