He allegedly asked her to accompany him "to a place" under the pretext of giving her an object, and thus led her to a small, abandoned building. Once there, the man allegedly began kissing and caressing her. When the woman refused to have sex, the prosecution maintains that he immobilized her and threw her onto an abandoned mattress to rape her. The document also includes insults that the defendant allegedly directed at her, such as "fucking Spanish woman" or "fucking fat woman," and expressions with which he compared her to a prostitute. The prosecution specifies that the victim had "a borderline intellectual disability that reduced her capacity for decision-making and defense," a factor that aggravated her vulnerability to the assault. After the events, the woman allegedly developed post-traumatic symptoms, including anxiety, recurring nightmares, and a rejection of her own body.
