Koldo García's silence before the judge in the case of the masks in the Balearic Islands

The former advisor to former minister José Luis Ábalos claims his right not to testify in the investigation into the purchase of sanitary material during the pandemic

PalmKoldo García, former advisor to former Minister of Transport José Luis Ábalos, has taken advantage this Thursday of his right not to testify before the National Court judge Ismael Moreno, as part of the investigation into the so-called ‘Koldo case’.

The summons has been issued as a result of the report by the Central Operative Unit (UCO) of the Civil Guard on the purchase of sanitary material in the Balearic Islands during the pandemic. As explained by his lawyer, Leticia de la Hoz, her client has chosen not to testify while awaiting the resolution of an appeal filed to request the dismissal of the case.

The defense maintains that the events for which he is being investigated would have already been judged by the Supreme Court and, therefore, considers that they cannot be the subject of criminal proceedings again. “We understand that the same events cannot be judged twice,” stated the lawyer.

De la Hoz has announced that, if the appeal is unsuccessful, the defense will request Koldo García's voluntary declaration at a later stage of the proceedings.

Furthermore, the defense has requested a copy of the mobile phones seized by the Civil Guard, understanding that her client needs access to the same material as the prosecution to prepare his defense. “He cannot defend himself until he has the same weapons as the prosecution,” concluded the lawyer.
