The Campos polo field regularizes works on rustic land and will pay 400,000 euros

PalmaThe Mallorca Territorial Defense Agency (ADT), an body dependent on the Consell de Mallorca, has imposed a global fine of more than 400,000 euros on companies linked to the Sa Barralina polo field, in Campos, for various urban planning infractions classified as very serious, as reported by Diario de Mallorca and confirmed by ARA Balears. However, the case has a relevant peculiarity: the works have been regularized by the promoters thanks to the amnesty applied by the Government of Marga Prohens in rural areas, and therefore the cost of the fine would have been double.

The resolution considers that Sa Barralina S.L. and Es Figueral Gran S.L.U. carried outworks and developed activities without the corresponding urban planning permit on protected rural land, on a property located near the natural environment of Es Trenc.

Activity without a permit on protected land

According to the file, the infractions include the use of a polo field of approximately 40,000 square meters without authorization, as well as the expansion of sports facilities and other interventions on land with maximum environmental protection. It also includes the transformation of an existing structure into a new building, within the same set of properties.

These actions are considered very serious infractions according to the Urban Planning Law of the Balearic Islands, as they involve both construction and land use without a license in a specially protected area.

Subsequent legalization and reduction of the sanction

Despite the severity of the sanction, the case falls within a broader scenario. The polo field facilities have been subsequently regularized thanks to a regulatory modification approved in 2025 by the Balearic Parliament, which provided legal coverage for this type of activity. This legalization has a direct effect on the sanction: urban planning regulations stipulate that, in the event of the restoration of urban planning legality, those responsible may benefit from a 50% reduction in the fine, which amounts to 400,000 euros.

In practice, this means that, even though the infraction is considered very serious and carries a high penalty, the fact of having subsequently regularized the situation significantly reduces the economic impact for the companies involved.

The two sanctioned companies have opted not to submit allegations within the period established by the ADT, a fact that is interpreted as an acceptance of the administrative resolution. This step also facilitates the application of the reductions provided for in the regulations.

A long-running conflict

The sa Barralina polo field has been mired in controversy for decades. The activity was carried out for years without a license, which led to actions by the Consell de Mallorca, including the sealing of the facilities in 2017.

However, in recent years, the resumption of activity has been detected, which led to new sanctioning proceedings and even communications to the Public Prosecutor's Office. Finally, the legislative modification approved in 2025 has allowed its legalization, completely changing the legal scenario.
