The Council will take the first cases of illegal tourist supply to the Public Prosecutor's Office
The Department of Tourism has initiated files with a sanction proposal that amounts to 4.3 million euros
PalmaThe Council of Mallorca will refer files on illegal tourist offerings to the Public Prosecutor's Office that, in the face of an order to cease activity, have disobeyed in a repeat manner. The Department of Tourism directed by Guillem Ginard is finalizing the complaints and expects to present them to the Public Prosecutor's Office "during this autumn". "We will take the multi-recidivism and the repeated failure to comply with the cessation of activity to the Public Prosecutor's Office," explained the island councilor.
The Council's Department of Tourism has resolved a total of 61 sanctioning files this year related to the new Abbreviated Declaration of Illegality (DIA) protocol. Of these, 36 have been classified as very serious, which implies sanctions between 50,000 and 500,000 euros, and 25 as serious. The total amount imposed in relation to these files amounts to 2.1 million euros.
The Abbreviated Declaration of Illegality is processed in parallel with the sanctioning file and has been applied since this year. While the sanctioning file sets the fine, the DIA allows an order to cease illegal tourist activity to be issued without waiting for the sanction process to finish. The order is also communicated to the platforms so that they remove the advertisement. If the activity continues beyond the ten days dictated by the order, it provides for coercive fines and, in case of persistence, transferring the case to the Public Prosecutor's Office.
"Our priority is clear and forceful: to achieve the removal, as soon as possible, of the advertisement that markets an illegal tourist accommodation in Mallorca. From there, the Administration will continue with the corresponding procedure and once the infraction is proven, the responsible party will receive the economic sanction established by the regulations," assured Guillem Ginard.
Offensive against illegal supply
Between the months of January and July 2026, Tourism has initiated 146 sanction proceedings with a financial proposal amounting to 4,373,415 euros. In any case, it remains to be determined what amount the Council has collected to date for these purposes.
Taking into account that 104 proceedings were initiated in 2025, the number of sanctions has increased by 40% in seven months compared to last year. Also during the same period, the resolution of these proceedings has increased by 10%.
The Council of Mallorca claims to have intensified measures to pursue illegal tourist offers thanks to the hiring of new processors, following the assumption of full powers in Tourism during this term, which has resulted in an easing of the "bottleneck" that caused the expiry of proceedings during processing. Currently, the department has 31 personnel in Inspection and 17 in Sanctions.
Inspections during the season
Tourism has carried out, for another year, the intensive campaign against illegal supply in high season. Up to the month of July, 1,546 inspections have been carried out. It is, according to the island institution, a "sustained action through inspections, which materializes with sanctioning files".
