They denounce irregularities in the selection process of the Balearic Foundation for Dependency
The Platform of Affected People warns that the selection process violates principles of merit and ability, excludes applicants with proven experience, and jeopardizes service to users.
PalmThe Platform of People Affected by the Selection Process for the Guardianship and Support Service for Adults of the Balearic Foundation for Dependency (FBD) publicly denounced on Tuesday the alleged existence of serious irregularities in the competitive examination called to fill staff positions corresponding to public offers 2 of 2 and 2. According to a statement released by the group, the selection process – published in the Official Gazette of the Balearic Islands (BOIB) on March 6 – violates the principles of ability, merit, and legal certainty, with direct consequences for both the applicants and the functioning of a public service they consider essential. The Guardianship and Support Service, responsible for complying with court orders, is currently, according to the platform, under severe strain, with high staffing levels and a high degree of complexity. In this context, they denounce that the deficiencies in the selection process jeopardize the continuity and quality of care for service users.
Among the elements that the Platform considers most serious is the fact that the competition was announced while some of the affected staff had already filed lawsuits to claim permanent positions, after having provided services for more than three uninterrupted years, a situation they describe as a circumvention of the law according to current regulations.
The group also points out that the process is currently under judicial review of the competition rules, with a request for precautionary measures. In this regard, they denounce that the court has neither requested nor allowed the resolution of documentation related to employment history, something that, they claim, generates serious legal uncertainty.
Another irregularity denounced is the failure to consider professional experience accredited through certificates of service rendered from the same FBD, despite the fact that, they maintain, this documentation is public and sufficient. At the same time, they criticize the requirement for a complete work history, which they consider disproportionate and contrary to the principles of proportionality, good administration, and data minimization. According to data provided by the group, this strict interpretation of the documentation has resulted in more than 41% of those who passed the exam being excluded from the merit-based phase and thus unable to score points in this section. Consequently, they denounce that applicants with higher scores or more accredited experience have been left out of the process, while others with lower scores or less professional experience have obtained positions. The Platform also denounces the lack of a reasoned response to the appeals submitted, the direct appointment of the selection panels, and the publication of personal data on the Foundation's website.
According to the group, the Balearic Islands Foundation (FBD) has recently announced that it will not recognize the right to compensation stipulated in the selection process rules for applicants who pass the tests under certain circumstances. They assert that this decision contradicts the literal content of the rules approved by the Foundation itself and leaves those affected in a state of legal defenselessness.
Faced with this situation, the affected individuals claim they are forced to resort to the Balearic Islands Arbitration and Mediation Court (TAMIB) to claim a right they believe has already been recognized, which entails an additional economic and emotional burden.
The Platform has requested meetings with the Ministry of Families, Social Welfare, and Dependency Care to discuss this issue and is awaiting a response. Finally, they demand recognition of the permanent status of staff whose employment is fraudulent, an immediate review of the selection process, and the opening of a genuine dialogue with those affected.
