The TSJIB annuls part of the Primary curriculum on Religion

Justice obliges the Government to modify the regulation of the subject after partially upholding the appeals of Escola Catòlica and the bishoprics

PalmThe High Court of Justice of the Balearic Islands (TSJIB) has annulled part of the decree regulating the curriculum for Primary Education and orders the Government to modify the regulation of the subject of Religion. Specifically, the sentence renders Article 8 of the norm ineffective.

This is the second resolution in this regard, following the one concerning Compulsory Secondary Education (ESO). Both respond to appeals filed by Escola Catòlica de les Illes Balears and by the bishoprics of Mallorca, Menorca, and Ibiza, who questioned the regional regulations.

According to the appellant entity, the new curriculum decrees approved by the Government have already incorporated partial modifications in line with the court's criteria. Nevertheless, they consider that there are still aspects of the regulation of the Religion subject that do not comply with state legislation.

In this context, Escola Catòlica has announced that it will challenge decrees 41/2025, 42/2025, and 43/2025, which regulate the curricula for Primary, Secondary, and Baccalaureate. The entity regrets having to repeatedly resort to the courts because it understands that the rights of its centers and families are being violated.
