Condemn Tirme, UGT and ARL for excluding CCOO from a meeting on working conditions

The sentence considers illegal the exclusion of a union delegate from a meeting where labor issues were debated and sets a compensation of 6,000 euros for moral damages

PalmaA court in Palma has partially upheld a lawsuit filed by CCOO de l'Hàbitat against Tirme, UGT, and ARL for preventing the participation of the CCOO delegate in a meeting where labor issues were discussed.

The judicial ruling concludes that the fundamental right to union freedom was violated by preventing the participation of the CCOO delegate in a meeting of the Labor Commission held on January 9, 2025, where issues related to the regulation of the staff's working conditions were addressed, the union assures.

The court jointly orders Tirme, UGT, and ARL to compensate CCOO de l'Hàbitat de les Balears with 6,000 euros for moral damages and obliges the company to publish the sentence on its corporate intranet. CCOO considers that the sentence represents a "forceful judicial reprimand" to a course of action that sought to exclude a legitimately represented trade union organization in the company from a body where decisions affecting workers were debated and made.

Although the court has not declared the nullity of the regulations approved in that meeting, it does recognize that the exclusion of the CCOO representative violated fundamental rights. CCOO considers it "especially serious" that a company "that provides an essential public service for Mallorca" has been condemned for an action contrary to union freedom. It also regrets that trade union organizations "that must ensure the defense of workers' rights participated in or endorsed a decision that has ultimately been considered harmful by the courts".
