The baby thrown into a container in Portocristo in November 2023 had a pulse upon arrival at Levante Hospital, although this could have been due to the resuscitation efforts being performed. In Tuesday's session of the jury trial at the Provincial Court against the child's mother, her brother-in-law, and her sister, a nurse who attended to the newborn at the hospital recalled that the baby's heart was beating, although he insisted that this could have been due to the resuscitation efforts undertaken by all those involved upon confirming the newborn's non-viability. The first to testify was a doctor who, in similar terms, indicated that the baby had oxygen in its blood, although it was already separated from the placenta, which can be considered a sign of vitality. "It's possible that it was alive, but whether it was viable is another matter, especially with the resources available at Levante Hospital," she noted. At the start of the hearing, the presiding judge informed the jury that the baby's mother was hospitalized and had expressed her desire to waive her right to be present at the trial. The mother and the baby's uncle were again in the dock, with the prosecution requesting life imprisonment with the possibility of parole for the latter as alleged perpetrators of murder. The mother's sister-in-law is also accused and faces a fine of €5,400 for allegedly failing to render aid. According to the prosecutor's indictment, the events occurred on November 3, 2023, when the woman, 26 or 27 weeks pregnant, became involved in a car accident in which she was traveling with the other two defendants. After giving birth, and despite being in the vicinity of a hospital, the baby's mother handed the newborn's body over to the man because he threw it into a nearby dumpster and they fled the scene.

A National Police officer who responded to the call explained this Monday to judgment that the baby was still moving when they found her. "She was having some spasms and movement. She was moving a little. A little bed was moving," he said during his testimony before the jury at the Provincial Court of the Balearic Islands.
The witness said that when he and his partner arrived at the scene, the child had already been located by local police officers, who had responded first to the call. According to his account, the baby was inside a box in the municipal police vehicle. His partner, who also testified during the session, corroborated this version and confirmed that the baby was showing some movement at that time. After the discovery, the local police officers took the baby to the hospital, while the national police officers secured the area.
During the session, a sub-inspector of the National Police who participated in the investigation and the wiretaps of the baby's mother also testified. He stated that, in a conversation with another person, the woman claimed that she "I would have buried her so that no one would find out"During the questioning, the recording of a call made by a neighbor to 112 on the day of the incident was also played. The woman explained to the operator that she had heard a woman crying in a car and had seen a man throw something into a dumpster. "I don't know if it's a baby or a dead animal. I think I saw a baby," she told the emergency operator at the time.
