Five years in prison for a tattoo artist who sexually assaulted a client in Ibiza
PalmThe First Section of the Provincial Court of Palma has sentenced a tattoo artist from Ibiza to five years in prison for sexually abusing a client in June 2022, as reported by the High Court of Justice of the Balearic Islands (TSJIB). The judges consider it proven that on June 15, 2022, the victim, who was on vacation in Ibiza, went with a friend to the defendant's establishment to get a tattoo. The two women agreed to get the same design. To get it done, they had to go into a small room with a bunk bed, while the other waited on a sofa in an adjoining room. The victim was the second to get the tattoo. According to the ruling, a few minutes after beginning the tattooing process, and taking advantage of the fact that the victim was not wearing underwear, the man subjected her to groping and penetrated her with his fingers for almost half an hour. As a result, the victim suffered so much fear that she was unable to react to what was happening and was paralyzed "for fear that it could be worse if she moved." The accused denied the events, but the judges believe that they have not only been sufficiently proven, but also point out that he knew that by acting in this way he was invading the woman's "sexual privacy." The judges found no reason to doubt the victim's credibility or that she had any "ulterior motive" in giving her incriminating account. In addition, as stated in the ruling, a series of supplementary pieces of evidence, analyzed as a whole, contribute to reinforcing the veracity of the complainant's testimony. For example, a Civil Guard officer testified at the trial that, when they received the complaint, they had already been arresting the defendant for a week for similar offenses. The officer stated that he knew the defendant had a criminal record. In fact, during the hearing, the prosecution presented a sentence in which, after reaching a plea agreement, he was sentenced to two years in prison for sexually abusing another client, this one 15 years old. The sentence is not final, and there is no appeal pending before the Civil and Criminal Chamber of the High Court of Justice of the Balearic Islands.
