Sineu and Costitx join GADMA and Pro Camins to open the Casa Baixa public path

SinedMore than a hundred people, including the mayors of Sineu and Costitx, have supported GADMA (Group of Friends in Defense of the Environment) and the Platform for Open Public Paths to demand the enforcement of the two rulings that call for the opening of the Casa Baixa public path, which connects Sineu and Costitx.

Bernat Fiol, spokesperson for GADMA, announced the latest ruling, which reinforces the first, issued in 2009, and clearly states that the road is publicly owned. Fiol thus asked the mayors to do their work to comply with the ruling and that "the road will be open before the end of this year."

Today, a large barrier blocks access to Costitx within the municipality of Sineu.

Toni Salas, mayor of Costitx, and Tomeu Mulet, mayor of Sineu, have indicated that their municipalities do not have this ruling and have expressed their intention to study the case and enforce the ruling once they are officially informed. Both Mulet and Salas explained that the important thing is to follow the procedure. "We will activate the legal services, since the opening of this road is positive for both municipalities, but we must do things properly."

Among the more than 120 people gathered at the point where the barriers of the Casa Baixa estate block the passage, three women from Costitx spoke about how, as dolls, they walked the entire route between Costitx and Sineu with their teacher, Don Luís. These women said they are now 46 years old.

Another witness explained that one day they found the barrier open, a group of cyclists rode the path with their bikes and all arrived back in Costitx scratched from the dirt on the path.

Here, Bernat Fiol informed the mayors that "now that the barrier has been removed, both GADMA and Pro Camins Públics are committed to cleaning the entire path and that it will not cost the town councils a euro."

Among the people who came to support were people from all over Mallorca, and in some of the interventions, in addition to giving examples of other paths on the island, they wanted to make it very clear that a public path is public, whether it appears in the municipal catalog or not.

Documentation

More than four decades of historical and administrative documentation confirm the public nature of the old Costitx road, also known as the Casa Baixa road. This road, which connects the urban centers of Sineu and Costitx, was already recognized as public by a court ruling from Palma's Administrative Court No. 2 in December 2009, following an appeal filed by private individuals seeking to block access.

The 2009 ruling established that it was a road for traditional public use, based on its appearance in municipal inventories, cadastral documents, and historical records.
