The Government turns into a rule the exceptional hiring of interim staff without Catalan

PalmaThe Government has approved the bases that will allow for the exceptional filling of job positions with people who do not have the required level of Catalan when there are not enough candidates who meet this requirement. The resolution of the Ministry of Labor, Public Function and Social Dialogue establishes the conditions for being able to resort to this procedure, provided for in the modification of the regulations on the requirement of Catalan language knowledge for access to the public service approved this year.

The document does not specify any number of positions nor does it open any call at this time to fill specific roles. The procedure can only be activated when a job position has remained unfilled after two consecutive collective calls because there are no applicants who meet the Catalan requirement. In this case, the General Directorate of Public Function may request the Balearic School of Public Administration (EBAP) to make an extraordinary cut of the corresponding single pool. It will be a subsequent resolution of the EBAP that will specify the body, the scale and, if necessary, the specialty of the pool, in addition to the position or positions to be filled, the exemption from the Catalan requirement and the deadline for submitting applications.

Catalan, preferred

In order to be eligible for these positions, candidates must meet all the requirements demanded for the post, except for the Catalan language requirement. However, individuals who do provide proof of Catalan language knowledge will have preference in obtaining the position, even if they have a lower score. Among these, priority will be given to those with a higher level of Catalan. If the level is the same, merit scores will be taken into account, in accordance with the criteria of the employment pool.

Interested parties will have five business days to submit their application and provide proof of their merits from the date of publication of the document opening each procedure. Individuals who obtain a position through this channel without having the required level of Catalan will have three years to certify it. If, after this period, they have still not obtained it, they will be dismissed.

This channel will also not allow for direct incorporation into the ordinary employment pool. Those who participate in it will not be able to opt for it until they certify the required level of Catalan. Once they do so, they will be incorporated ex officio in the first update cut-off that takes place. The list created through this procedure will last for eight months. During this time, if a position in the same employment pool becomes vacant again and the conditions for applying this system are met, the Administration may resort to this list. The resolution also establishes what will happen if, at any time, interim staff occupying a vacant position must be dismissed. In this case, preference for dismissal will be given to the person who entered through this exceptional procedure without certifying Catalan, before another person who accessed it through another channel of the employment pool and who does meet the requirement.
