They admit for processing the appeal against the dismissal of the accusation for animal abuse against the Llucmajor poultry mega-farm
The Provincial Court of the Balearic Islands will review the decision of a court in Palma that had closed the investigation, following the appeal filed by the neighborhood platform and animal welfare organizations.
PalmThe Provincial Court of the Balearic Islands has admitted for processing the appeal against the dismissal of the investigation for animal abuse against the poultry mega-farm in the Mallorcan municipality of Llucmajor after upholding the appeal by 'STOP macrogranja Llucmajor. It should be recalled that last February an investigating court in Palma archived the case, although the possible filing of appeals was still pending. At that time, the judge considered that the poultry mega-farm presented various "deficiencies" which, in his opinion, were not constitutive of an animal cruelty offense. It was the organizations Satya and CREMA that reported the poultry mega-farm, located in the Mallorcan municipality of Llucmajor, to the Prosecutor's Office for alleged offenses against public health and fraud.
Both animal and environmental protection entities published an investigation last April in which they found that the place presented a significant lack of hygiene, with cobwebs and a mixture of dust, dirt, and feathers. As a result of the complaint, government inspectors and the Civil Guard inspected the facilities and the closure of one of the farm's sheds was ordered.
After the case was filed, the neighborhood platform formed against the exploitation, 'STOP macrogranja Llucmajor. Sin Olor ni Moscas' (No Smell or Flies), appealed the sentence before the Provincial Court of the Balearic Islands. In the appeal, the residents indicated that the judge had ordered the dismissal "without having carried out the most essential investigative steps," and had prejudiced their right to effective judicial protection.
Thus, they maintained that the fact that the magistrate had not observed indications of a crime did not mean that they did not exist, but rather that "not even" the investigative possibilities had been initiated, and they requested the carrying out of various steps.
