Evict a mother and her two children from a home in Calvià after the end of the eviction moratorium
The family has been evicted from the dwelling where they lived in El Toro and has found temporary shelter in a small accommodation in the same municipality
PalmaA mother and her two minor children were evicted this Monday from the home where they lived in El Toro, in the municipality of Calvià, in a case that, according to Stop Evictions Mallorca, was protected until a few months ago by the anti-eviction moratorium for vulnerable families included in the so-called social shield approved during the pandemic.
Sources from the platform have criticized the execution of the eviction and have assured that the judicial commission opted to continue with the process despite the family not having a stable housing alternative. In this regard, they recalled the instruction of the Superior Court of Justice of the Balearic Islands (TSJIB) of 2013, which allows suspending these types of actions when there are minors in charge and no adequate residential solution exists. According to Stop Evictions Mallorca, the woman contacted the entity recently, which prevented an mobilization from being organized to try to stop the eviction.
The platform points out that it is a foreign woman residing in Mallorca for years and who would have been a victim of gender violence. It also maintains that she has ongoing legal proceedings related to the custody of her children after her ex-partner temporarily moved them abroad. Regarding the family's economic situation, Stop Evictions indicates that the woman was renting the property and that the loss of her job at the company linked to her ex-partner caused a significant reduction in income. This circumstance would have led to financial difficulties and the accumulation of debts that finally resulted in the non-payment of rent.
The entity explained that the eviction procedure began last year, but was suspended thanks to successive extensions of the moratorium approved during the covid-19 crisis. With the disappearance of this protection, the process resumed last February. According to the platform, the owners were able to carry out the eviction because they were not classified as large holders. However, Stop Evictions maintains that they could own several properties both in Spain and abroad.
The organization has also attacked the judicial system, which it accuses of not effectively applying the mechanisms that allow the suspension of evictions of vulnerable families with minors. After the eviction, the family has managed to find provisional accommodation in a 24-square-meter space within the same municipality of Calvià. Stop Evictions regrets that the situation has particularly affected the two minors, who face the end of the school year amidst a context of housing uncertainty.
