Five years in prison for raping his three-year-old daughter in Palma

The First Section of the Provincial Court has sentenced a man to five years in prison for sexually abusing his three-year-old daughter in Mallorca during visitation rights, although he was acquitted of the charge of sexual assault for which he was also accused. The man must also pay €25,000 in compensation for moral damages. The Court also imposed a restraining order prohibiting him from approaching the child for the next six years. During the trial, held in February in Palma, the man denied having used visitation rights to sexually abuse his daughter and attributed the accusation to revenge by the mother and the influence of her family. The Court, however, considered it proven that between 2016 and 2018, the man, who had a history of domestic violence and sexual abuse, took advantage of his daughter's visits to sexually touch her.
According to the prosecution's report, the events date back to 2018. The accused, who already had a record for gender-based violence and sexual offenses, allegedly took advantage of contact with the doll during visits to the prison to sexually assault it. The prosecution also attributes to him a previous sexual assault, committed before his imprisonment, when he allegedly raped the minor at his family home in Palma.
