PalmaComissions Obreres denounced this Friday the labor situation that, according to the union, more than 250 workers at Ultramar Express Transport, a local subsidiary of the TUI tourism group, are suffering. Coinciding with the TUI Palma Marathon Mallorca, on October 17th and 18th, the union accuses the management of maintaining an environment of labor pressure that puts the mental health of the drivers at risk and reports alleged violations of union rights.

According to the CCOO union section, the discretionary transport drivers work in a context of continuous stress and pressure, which it attributes to internal discrimination, job insecurity, and organizational reprisals. The union considers that these practices constitute psychosocial risk factors that can affect both the well-being of the workers and road safety. The complaint comes during a weekend in which TUI projects an image linked to well-being, health, and sports with the Palma marathon. CCOO contrasts this public image with the working conditions that, it claims, the staff of its transport subsidiary in Mallorca are suffering.

Complaint before the Labor Inspectorate

The works council has already filed a formal complaint with the Labour and Social Security Inspectorate against Ultramar Express Transport for an alleged violation of the fundamental right to trade union freedom, enshrined in Article 28.1 of the Constitution. Among the irregularities reported, CCOO points to the obstruction and concealment of mandatory information from trade union representatives. According to the union, the management allegedly selectively blocked access to documentation while granting preferential treatment to members from another trade union representation.

It also reports alleged discrimination in working conditions, especially in the assignment of vehicle transfer services to the Peninsula. CCOO maintains that a part of the staff has been excluded from these operations without adequate justification and that the economic allocation of the services has been used as a mechanism of pressure and punishment. "It is legally and ethically unacceptable that a multinational with the prestige of the TUI group does not have real mechanisms for compliance control and allows local management to engage in harassment practices that undermine the mental health of workers," union spokespersons point out.

CCOO prepares legal action

Faced with the refusal attributed to management to establish collective bargaining channels in good faith, the workers' legal representation and CCOO have confirmed that they have initiated the procedures to turn to the ordinary social jurisdiction. The union, through the Road and Logistics coordination, demands that the conduct it considers workplace harassment cease immediately and that the rights it denounces as violated be restored. At the moment, the information provided by CCOO does not include the version of the management of Ultramar Express Transport or the TUI group regarding the accusations.
