A family from Son Oliva manages to postpone eviction by a week at the last minute

PalmaA family from Son Oliva has managed to postpone the eviction from the flat where they live for another week after filing a last-minute document with the court, as their assigned lawyer had not processed the request for provisional suspension of the eviction despite being asked to do so.

The eviction was scheduled for 11:00 AM this Tuesday in a dwelling on Eusebi Estada street, where a married couple and their 22-year-old son reside. According to Stop Evictions, the family had an assigned lawyer who had assured them that she could do nothing to prevent the eviction. However, the affected parties asked her to file a petition to provisionally suspend the eviction, a procedure that, according to the lawyer, she was supposed to do last Monday afternoon.

This Tuesday morning, however, the mother of the family went to the court, advised by members of Stop Evictions, to check if the petition had been admitted. There she discovered that the document had not even been filed. With the support of the association and the help of a court official, they were able to file the document at the last minute and thus obtain a temporary suspension of the eviction.

The plan is for the proceedings to resume next week. According to Stop Evictions, the family could still explain their lawyer's actions to the court and request a change of legal representation, which would allow part of the proceedings to be restarted and the eviction to be postponed again.

The affected parties are in an irregular administrative situation and currently have no income. Given the lack of housing alternatives, when the eviction resumes, they will have to resort to a shelter. The three members of the family have initiated the procedures to avail themselves of the extraordinary regularization process. They are hopeful that this route will allow them to obtain a work contract and, consequently, access rental housing.
