The Supreme Court upholds the ruling forcing the closure of Alcudiamar

PalmThe Supreme Court (TS) has dismissed the appeal filed by the Alcudiamar company challenging the closure of the hotel located in Puerto de Alcudia. The GOB, one of the entities that filed an appeal against the hotel, announced this Tuesday the court ruling, which upholds the ruling by the High Court of Justice of the Balearic Islands (TSJIB), which revoked the tourist authorization granted to Botel Alcudiamar and ordered its closure.

According to the environmental organization in a statement, the Supreme Court's decision closes a lengthy legal process initiated by the GOB (Basque Government) to denounce the tourist exploitation of an establishment built on public port land, intended exclusively for nautical uses. The TSJIB's ruling, now final, establishes that the hotel activity carried out in Alcudiamar is contrary to urban planning and tourism laws and nullifies the authorization granted at that time.

The organization has also asserted that the establishment remains open and operating "as if nothing had happened." Therefore, the GOB submitted a new document to the TSJIB requesting that the Consell de Mallorca and the company be urged to close the facilities. For environmentalists, this case exemplifies the "perverse effects of institutional permissiveness" regarding illegal activities on the coast and highlights the need for "a profound change of criteria" in port and tourism management. However, they demanded that the Mallorca Council and the competent port authority act "with maximum speed" to enforce the closure.
