Life imprisonment for the woman who caused the fire that killed an elderly man in Ibiza

PalmThe presiding judge of the Jury Court of the Provincial Court of the Balearic Islands has sentenced the woman accused of the deadly fire in Les Països (Ibiza), in which an elderly man lost his life, to life imprisonment with the possibility of review. The judge convicted her of aggravated murder of a particularly vulnerable person and of arson. According to the ruling, the defendant will not be eligible for parole until she has served 15 years in prison and will not be eligible for temporary release permits until she has served eight years. Furthermore, the woman may be eligible for a suspended sentence after serving 25 years, provided she meets the requirements stipulated in Article 92 of the Penal Code. Regarding civil liability, the convicted woman must pay €86,484 in compensation to the deceased's wife and €62,268 to each of his three children. On the other hand, she will also have to pay €48,201 and €179 for the damage caused to the burned property. According to the sentence, "in accordance with the conclusions of the jury members and the doctrine of the Supreme Court, it is justified to apply the mitigating circumstance of mental impairment to the woman."

It should be recalled that the Jury Court of the Provincial Court of the Balearic Islands considered that the accused suffers from schizoaffective disorder, but that at the time of the events her capacities were not completely nullified. The jury issued a guilty verdict against the defendant accused by the Public Prosecutor's Office of starting a fire that killed a 77-year-old man in Ibiza in 2023. The jury members considered it proven that the defendant was familiar with the house she entered with a key, having previously cared for the occupants while they were asleep. The jury members stated that the defendant committed this act while they were asleep, intending to ensure the desired fatal outcome without taking any risk herself and preventing them from escaping the fire. The sentence is not final and an appeal can be filed with the Civil and Criminal Chamber of the High Court of Justice of the Balearic Islands.
