Port Authority guarantees the continuity of the Royal Nautical Club of Palma

PalmThe board of directors of the Balearic Islands Port Authority (APB) has approved the granting of a temporary occupancy permit for the Real Club Náutico de Palma (RCNP). The measure, adopted this Wednesday, will allow the club to continue its activities in its current premises until the extension of the concession term and the renewal of the concession for 20 years are formalized. In this way, the APB emphasized, the ruling of the High Court of Justice of the Balearic Islands (TSJIB) that recognized the RCNP's right to retain its facilities will be fulfilled.

The board of directors has also agreed not to file an appeal with the Supreme Court against the aforementioned judicial decision, and will therefore fully accept its content and facilitate its implementation.

Background

In 1978, the Palma Yacht Club was awarded the contract for the management and operation of the area designated for recreational boating in the Sant Pere dock and the Mollet breakwater, a contract that has been modified several times. Starting in 2015, the RCNP (Royal Nautical Club of Palma) requested an extension of the concession term and renewal of the concession title under the consolidated text of the State Ports and Merchant Marine Law. The Port Authority of the Balearic Islands (APB) agreed with the RCNP on the conditions under which the extension should be granted, but the "legal complexity" of the case prompted reports from State Ports, the State Attorney's Office, and the Council of State, whose divergent interpretations led to the delay in granting the extension. In 2022, the RCNP filed an administrative appeal due to administrative silence regarding its requests. In November 2025, the High Court of Justice of the Balearic Islands (TSJIB) issued the aforementioned ruling, upholding the appeal and recognizing the right to an extension of the concession period under the agreed terms. Following the court decision, at the request of the RCNP, both parties have agreed to continue the procedure to implement its provisions. In this context, and to avoid any interruption of activity due to the expiration of the temporary authorization, which is valid until December 31st, it has been decided to grant a new permit while the processing of the definitive concession title is completed.
