The Executive prohibits the tourist rental of private boats

All those who embark or disembark at any point on the Balearic coast will have to present a responsible declaration.

PalmThe Government Council has approved an amendment to the Nautical Charter Decree prohibiting the tourist rental of private vessels, something that the new state regulations will allow starting in mid-August. Government spokesperson Antoni Costa announced this decision at the press conference following the meeting of the Council, after President Marga Prohens announced that this would be done after meeting with the nautical sector.

The approved decree modifies the existing decree regulating the rental of recreational boats and vessels and limits the application of the new state regulations, which will allow the owner of a private vessel to rent it as if it were on the sixth list for three months a year.

"This new regulation adapts to the current reality of the sector and aims to bring order to a growing activity, reinforce user safety, protect the coastline, and ensure a balanced coexistence between the different uses of the sea," the Government explained.

The text establishes that all vessels embarking or disembarking at any point along the Balearic coast—regardless of their home port or flag—will be required to submit an annual declaration of responsibility to operate, which will entail compliance with several documentary, technical, fiscal, and environmental requirements. Furthermore, they must be registered in the new Balearic Registry of Chartered Vessels, which is essential for legally operating the activity.

Code of Good Practices

The Decree also incorporates a code of good environmental and safety practices, such as a ban on anchoring over posidonia, the obligation to inform clients about protected areas and proper waste management, as well as requirements to improve safety on board and coexistence with other maritime activities.

Inspection and control mechanisms are also strengthened, and measures are introduced to prevent the fraudulent use of private vessels for commercial purposes, in coordination with the competent merchant marine authorities.
