MORE asks to update the Balearic Civil Law to not leave families of people with disabilities "helpless"

PalmaMÉS per Mallorca has registered an initiative in the Balearic Parliament for the Advisory Council of Civil Law of the Balearic Islands to promote a reform of the Compilation of Balearic Civil Law following the changes introduced by state legislation and, in this way, not to leave families of people with disabilities "helpless". As the party has reported, in 2021, the state government modified the regulations on the legal capacity of people with disabilities, eliminating the declaration of incapacity, a figure on which part of the regulation of Balearic Civil Law was based.

As a consequence, they explain, one of the legal institutions specific to Mallorca and Menorca, the exemplary substitution, has become outdated and "needs a legal update so that families can continue to use it with all guarantees". This figure allows parents of a person with a disability to order what will happen to their inheritance when they pass away, which would avoid unwanted situations and provide more security for their children's future.

As explained by the parliamentary spokesperson for MÉS per Mallorca, Lluís Apesteguia, they demand that "a change in state legislation does not mean the loss of a useful tool that for years has given peace of mind to many families". The initiative also calls for an update to the right of residence and the right of habitation, two figures of Balearic civil law that also protect people with disabilities.
