PalmaThe court number 8 of the Instruction Section of the Palma Court of Instance has declared the nullity of the proceedings related to the appeal in the framework of the complaint filed by Jorge Campos against the former President of the Parliament of the Balearic Islands, Baltasar Picornell. The magistrate considers that during the processing of the appeal, the legally established procedure was not respected, a fact that caused defenselessness to the parties.
The resolution, issued on October 23 by magistrate Antonio Rotger Cifre, agrees to annul all actions taken starting from the procedural order of October 2, 2026. The nullity also affects the referral of the appeal to the Provincial Court. The decision was adopted ex officio, in the terms that had been requested by the public prosecutor in a report from October 16 incorporated into the case. The judge considers that the correct procedure was not respected in the processing of the appeal and that this irregularity has caused the parties' inability to defend themselves.
For this reason, he orders the actions to be set back to the moment before the annulled order and to issue a new ruling that resolves the admission of the appeal and the corresponding transfer to the parties. The resolution does not enter into the merits of the complaint filed by Campos against Picornell, but rather affects exclusively the procedural processing of the appeal. What is annulled is the processing of the appeal due to a procedural irregularity that, according to the judge, has caused a lack of defense.
