PalmaThe First Section of the Provincial Court of the Balearic Islands has summoned the President of the Parliament, Gabriel Le Senne, to a preliminary hearing this Wednesday, October 28th, before the oral trial is held for an alleged hate crime. The appearance will serve to prepare the proceedings and gather the parties before the oral hearing, which still does not have a set date.

This procedural phase allows, among other issues, for the proposal of possible plea agreements to avoid going to trial. In Le Senne's case, however, this possibility seems difficult, as both the President of the Chamber and the Prosecutor's Office have maintained that no crime occurred. The popular accusations, on the other hand, are requesting prison sentences and disqualification from holding public office. The highest request is for four years in prison. If no agreement is reached, the Provincial Court will have to set a date for the oral trial against the leader of Vox in the Balearic Islands as well.

The case dates back to the plenary session of Parliament in which the repeal of the Democratic Memory Law was being debated, during which Le Senne tore up a photograph of the 'Roges del Molinar', victims of Francoism. The events took place during the debate on the initiative, which has been raised again subsequently.

In February 2025, the investigating judge decreed the opening of an oral trial against the President of Parliament for these events. The decision, however, remained pending after Le Senne's legal representation and the Prosecutor's Office filed appeals against some of the magistrate's resolutions.

The case thus remained pending the Provincial Court's resolution of the appeals. The court dismissed them in June 2025, so the decision that Le Senne had to sit in the dock became final. Now, more than a year after the opening of the oral trial, the procedure enters a new phase with Wednesday's summons. The appearance will serve to prepare the hearing and determine if the case continues to the oral trial, in which the facts and criminal responsibilities that the accusations attribute to the President of Parliament will have to be examined.
